  • 1 Scope
  1. The following General Terms and Conditions, in the version valid at the time of the order, shall apply exclusively to the business relationship between The Wu Wear Online Shop, Intra Consulting & Investment GmbH, Am Steinberg 10, 97456 Dittelbrunn Germany
    Germany and the customer when ordering goods in the online shop.

  • 2 Conclusion of contract
  1. The languages ​​available for concluding the contract are German and English.
  2. The presentation of goods on WuWear.net does not constitute a legally binding offer by The Wu Wear Online Shop to conclude a purchase contract, but rather a non-binding online catalog. Only the customer's order of goods constitutes a binding offer to The Wu Wear. Online shopping constitutes the conclusion of a purchase contract. The customer submits a binding offer for all items in their shopping cart by clicking the "Order with payment" button during the ordering process. Confirmation of receipt and acceptance of your order will be sent via an automated email immediately after submission.
    With this email confirmation the purchase contract is concluded.

    After receipt of the order, The Wu Wear O nline S hop will inform the customer about the receipt of their order by email, which will include the details of the order (order confirmation). Upon receipt of the order confirmation, the purchase contract is simultaneously accepted by The Wu Wear O nline S hop . Only orders in normal household quantities will be accepted. This also applies in the event that the usual household quantity is exceeded by placing multiple orders from the same customer, even if the individual orders only contain a normal household quantity of the product. The only exception to this is customers who have previously been granted B2B status by The Wu Wear O nline S hop and who can only order in quantities larger than normal household quantities as a result of this.
  3. The Wu Wear O nline S hop only wants to enter into contractual relationships with adults.

  • 3 Right of withdrawal

"Cancellation policy

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period shall be fourteen days from the date on which you or a third party other than the carrier designated by you takes possession of the goods. If you make use of this option, we will immediately send you confirmation of receipt of such a revocation (e.g. by email).
To comply with the cancellation period, it is sufficient that you send the notification of the exercise of the right of cancellation before the expiry of the cancellation period.

Consequences of revocation

If you cancel this contract, we will refund all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a delivery method other than the cheapest standard delivery offered by us), promptly and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you; under no circumstances will you be charged any fees for this refund. We may refuse to refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.
You must return the goods to The Wu Wear O nline S hop promptly and in any event no later than fourteen days from the date on which you notify us of the cancellation of this contract. This deadline is met if you send the goods before the expiry of the fourteen-day period. You will bear the direct cost of returning the goods.

  • 4 Availability of goods
  1. The Wu Wear The Wu Wear Online Shop is entitled to withdraw from the contract if its suppliers fail to deliver correctly and/or on time. However, the right to withdraw does not exist if The Wu Wear Online Shop is responsible for the unavailability of the goods. The customer will be informed immediately of the unavailability of the goods. Any consideration paid by the customer will be refunded immediately.

  • 5 Delivery conditions
  1. Unless otherwise agreed, delivery will be made to the delivery address specified by the customer.
  2. Deliveries are made exclusively within Europe.
  3. For deliveries to Germany and Austria, only DPD or DHL Classic shipping methods are offered.
  4. The Wu Wear The online shop reserves the right to make partial deliveries, provided this is reasonable for the customer. For partial deliveries , the customer only has to pay the shipping costs that would have been incurred if the entire order had been delivered.
  5. If the customer defaults on acceptance or culpably violates other obligations to cooperate, The Wu Wear Online Shop is entitled to demand compensation for the resulting damages, including any additional expenses. Further claims remain reserved.
  6. The risk of accidental loss or accidental deterioration of the purchased item shall pass to the customer at the time the customer defaults on acceptance.

  • 6 Prices, minimum order value, costs
  1. The prices valid at the time of order apply. All prices include the applicable German VAT.
  2. The minimum order value per order is €15.
  3. The following shipping costs apply:

    For the "DPD Standard Parcel" shipping method, shipping costs of €3.55 apply per order for orders up to a value of €64.99. Shipping costs are free for orders over a value of €65.

    For deliveries to Austria using the "DPD Standard Parcel" shipping method, shipping costs of €6.93 per order will be charged for goods up to a value of €28.99. There are no shipping costs for goods valued at €65 or more.

  • 7 Payment conditions
  1. The purchase price is due for payment upon conclusion of the purchase contract.
  2. The customer has the option to pay via PayPal or credit card.
  3. There is no possibility of deducting a discount.

  • 8 Simple retention of title

The delivered goods remain the property of The Wu Wear O nline S hop until the purchase price has been paid in full.

  • 9 Extended retention of title for entrepreneurs

If the customer is an entrepreneur, i.e. a natural or legal person or a partnership with legal capacity who, upon conclusion of the legal transaction, is acting in the exercise of their commercial or independent professional activity, the customer is entitled to resell the goods subject to retention of title in the ordinary course of business. In this case, however, the customer hereby assigns to The Wu Wear O nline S hop all claims from such resale, regardless of whether this occurs before or after any processing of the goods delivered subject to retention of title, in the amount of the final invoice amount ( including VAT ). Irrespective of the authority of The Wu C orner O nline S hop to collect the claim itself, the customer remains authorized to collect the claim even after the assignment. In this context, The Wu Wear O nline S hop , not to collect the claim as long as and to the extent that the customer meets his payment obligations, no application for the opening of insolvency or similar proceedings has been filed and no payment has been suspended. However, if this is the case, The Wu Wear O nline S hop may require the customer to inform The Wu Wear O nline S hop of the assigned claims and their debtors, provide all information necessary for collection, hand over the relevant documents, and notify the debtors of the assignment. To the extent that the above-mentioned securities exceed the claims to be secured by more than 10%, The Wu Wear O nline S hop is obliged to release the securities selected by The Wu Wear O nline S hop at the customer's request.

  • 10 Warranty

If there is a defect in the ordered goods, the statutory provisions apply.

  • 11 Liability
  1. The Wu Wear O nline S hop is fully liable for damages in the event of intent or gross negligence.
  2. Liability for simple negligence only exists for damages resulting from injury to life, body, or health, as well as for the breach of a material contractual obligation, the fulfillment of which is essential for the proper execution of the contract or the breach of which jeopardizes the achievement of the contractual purpose and on whose compliance the customer regularly relies (cardinal obligation). In the event of a negligent breach of cardinal obligations, liability is limited to damages typical for the contract and foreseeable.
  3. Statutory liability without fault (e.g. under the Product Liability Act) and liability arising from the possible assumption of a guarantee remain unaffected.
  4. The legal representatives, employees and vicarious agents of The Wu Wear Online Shop
    are not liable beyond The Wu Wear Online Shop
    himself.

  1. The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods. This also applies if orders are placed from or delivered to a country other than Germany.
  2. If the customer is a merchant, the exclusive place of jurisdiction for disputes arising from or in connection with the business relationship is Germany. The same place of jurisdiction applies if the customer's place of residence or habitual abode is unknown at the time the lawsuit is filed. If the customer does not have a general place of jurisdiction in Germany, the exclusive place of jurisdiction is the registered office of The Wu Wear Online Shop.
  3. Should one or more provisions be invalid, this shall not affect the validity of the remaining provisions.
